1. The contract between us
1.1 In accepting this agreement you declare that you are over 18 years of age.
1.2 In this agreement, we/us/our means E-Buy Radiators Direct Limited, a company registered in England and Wales under company NUMBER 4798062 and whose postal address is 173 London Road, North End. PORTSMOUTH. PO2 9AE
1.3 We must receive payment of the whole of the price for the goods that you order before your order can be accepted. Once payment had been received by us we will confirm that your order has been accepted by sending an email to you at the email address you provide in your order form. Our acceptance of your order brings existence a legally binding contract between us.
2. THE GOODS
2.1 The goods are displayed on our website (“THE GOODS”).
2.2 Pictures, dimensions and other informative details pertaining to the Goods are approximate only.
2.3 The specifications of goods delivered to you may vary slightly from those given on our website.
2.4 In the case of custom made goods, it is your responsibility to provide us with the specifications that you require.
2.5 We shall be under no liability in respect of any defect in goods ordered by you, such defect being a result of any drawing, design or specification supplied by you.
2.6 In the case of electric only, dual fuel, gold and specially coloured goods, will be commissioned for production by our manufactures on your behalf so our non returnable after commencement of work.
3. PRICE
3.1 The price payable for goods that you order are as set out in our website. Where goods are made to your specifications, the price for the goods will be notified to you separately by either e-mail or post. All prices are stated in pounds sterling.
3.2 You will not be required to pay extra for delivery to any mainland address in the UK. It might not be possible for us to deliver to some locations. Delivery charges to addresses mainland UK will be payable and these are available on request by you.
4. RIGHT FOR YOU TO CANCEL YOUR CONTRACT
4.1 You may cancel your contract with us for the goods you order at any time up to the end of the seventh working day from the date you receive the ordered goods. You do not need to give us any reason for cancelling your contract nor will you have to pay and penalty.
4.2 To cancel you contract you must notify us in writing by recorded delivery to the above address.
4.3 If you have received the goods before you cancel your contract then you must send the goods back to your contract address at your own cost and risk. If you cancel your contract but we have already processed the goods for delivery you must not unpack the goods when delivered to you. If you do not return the goods delivered to you or do not pay the costs of delivery, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.
4.4 Once you have notified us that you are cancelling your contract, any sum debited to us from your credit card will be re-credited to your account as soon as possible and in any event within 30 days of your order PROVIDED THAT the goods in question are returned by you and received by us in the condition they were in when delivered to you. If you do not return the goods delivered to you or do not pay the costs of delivery, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.
5. CANCELLATION BY US
5.1 We reserve the right to cancel the contract between us if:
5.1.1 We have insufficient stock to deliver the goods that you have ordered;
5.1.2 We no not deliver to your area; or
5.1.3 One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
5.2 If we do cancel your contract we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible but any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.
6. DELIVERY OF GOODS TO YOU
6.1 We will deliver the goods ordered by you to the address you give us for delivery at the time you make your order.
6.2 Delivery will be made as soon as possible after your order is accepted and we will use our best endeavours to ensure that the goods are delivered to you within 5 days and in any event within 30 days of your order.
6.3 You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.
6.4 Special delivery arrangements such as special packaging may be agreed with us at the time of making your offer to purchase goods. The cost of this will be charged to you at cost plus handling and administration charges.
7 WARRANTY AND LIABILITY
7.1 We will repair or replace free of charge goods or any part of such goods which are defective due to defective materials or workmanship only provided.
7.1.1 We receive forthwith on the defect being ascertained notice of the defect, and such defect has arisen within twelve months from the date of purchase and the goods are returned to us by you within twelve months from the date of purchase;
7.1.2 We are satisfied that the defect in the Goods is not due to wear and tear, accident, misuse, improper operation, neglect, failure due to incorrect installation or installation by unqualified persons; and
7.1.3 The goods have not been altered or used for any purpose other than those for which the Goods are reasonably suitable.
7.2 We will not be responsible for any delay in repairing defective parts nor for any consequential loss sustained by you by reason of such defects.
7.3 If the Goods delivered are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing by e-mail or at our contact address of the problem within 7 working days of the delivery of the goods in question.
7.4 If you do not receive Goods ordered by you within 30 days of the date on which you ordered them; we shall have no liability to you unless you notify us in writing at our contact address of the problem within 40 days of the date on which you ordered the Goods.
If you notify a problem to us under this condition, our only obligation will be, at your option:
7.4.1 to make good any shortage or non-delivery;
7.4.2 to replace or repair any Goods that are damaged or defective; or
7.4.3 to refund to you the amount paid by you for the goods in question in whatever way we choose.
7.5 Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business of goodwill) howsoever arising out of any problem you notify to us under these conditions and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under clause 7.4.3 above.
7.6 You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain goods of ours being sent to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.
7.7 You are responsible for ensuring that all goods should be suitably specified for the system type to be installed on. In areas where aggressive water prevails or where a water softener is installed the use of dezinctification resistant materials would be advised. We recommend that this is checked with the heating installer or local water authority because we accept no responsibility for premature failure due to corrosion.
7.8 Not withstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
7.9 We reserve the right to amend your order should we deem it reasonably necessary to do so provided always that any substitute goods are not materially different in nature and quality from the goods ordered by you.
8. NOTICES
Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent to us by e-mail or post to our contact address above and all notices from us to you will be displayed on our website from time to time.
9. EVENTS BEYOND OUR CONTROL
We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
10. INVALIDITY
If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.
